What GDPR Covers
The General Data Protection Regulation applies to any company that processes the personal data of EU/UK residents, regardless of where the company is based. AI companion platforms serving European users are bound by GDPR, even if they are US or Asian companies. This means European users have substantial legal rights over their data that users elsewhere may not have.
Your Key Rights
Under GDPR, you have the right to access all personal data the platform holds about you — including your conversation history, account information, and any inferred profile data. You have the right to rectify inaccurate data. Most importantly for AI companion users, you have the right to erasure — the “right to be forgotten” — which requires the platform to delete all your personal data upon request.
You also have the right to data portability (receiving your data in a machine-readable format), the right to restrict processing (limiting how your data is used), and the right to object to processing for certain purposes including direct marketing.
How to Exercise Your Rights
Contact the platform directly — most have a data protection contact or privacy email address in their privacy policy. Submit a Subject Access Request (SAR) to receive all your data. Submit an erasure request to delete your account and all associated data. Platforms must respond within 30 days under GDPR.
If a Platform Does Not Comply
If a platform fails to respond to your rights requests, you can complain to your national data protection authority. In the UK, this is the ICO. EU member states each have their own supervisory authority. These bodies have the power to investigate and fine non-compliant companies significantly.
